Legal basis for AI: Start with the specific task
Can a municipality use AI under the existing legal basis for a particular area, or does it need a separate basis? The discussion did not reach a shared legal conclusion. It highlighted the need to define the use clearly.
From the last Alliance meeting on
A general yes to AI is hard to work with.
The same tool can be used for different tasks. Purpose, information and workflow are therefore central questions: What should the system help with? What information is involved? How is the result used?
Human oversight needs to be described.
Saying that an employee reads the result does not, in itself, explain what the oversight involves. It becomes more concrete when it is clear what the employee should check, correct and consider.
What we take away
- Describe the specific use, rather than just the tool.
- Make the employee's oversight an explicit part of the workflow.
- Keep unresolved legal questions visible. Describing the use prepares for the assessment; it is not an approval.
